These are the Terms & Conditions for use of our website. They set out the Contractual Agreement between Members and visitors of this website and Module 5 Design Limited. A "Member" is any individual, or incorporated body, partnership, sole trader, association or any legally constituted organization. To qualify as a member you must be at least 18 years old and eligible to establish a legal contract under applicable law.
These Terms & Conditions also incorporate the Pastplaces.com Privacy Policy, which can be viewed at privacy. Together they constitute the whole of the Agreement between you and us concerning the PastPlaces Website and its Service. By registering as a member, you also agree to the method and means by which way we handle your personal data in the PastPlaces privacy policy.
MEMBERSHIP TYPES
Membership of Pastplaces.com is free of charge.
REGISTRATION PROCESS
When you register with PastPlaces as a member you obligate yourself to provide information that is both accurate and current. This includes any information that you provide as part of the registration process and any subsequent information provided to us in the course of your membership or information posted on the PastPlaces website.
INFORMATION RELEVANCE
PastPlaces is a forum and meeting place only, which brings members together with a common interest in places of the past and present. Information that is not in keeping with this purpose will be removed from this website without notice by PastPlaces.
MEMBERS COMMUNICATION RESTRICTIONS
Members, can elect to reveal their details and communication information with other Members if they so choose.
Under no circumstances will bulk messaging be allowed to multiple members if in the opinion of PastPlaces, these messages constitute a nuisance to other members or if the message is not relevant to the purposes of this website or the place in question. Members who bulk message or email will be removed from the service
ALERTING US ABOUT ABUSE OF THE SYSTEM
Please report any abuse of the system by contacting pastplaces PastPlaces does not generally monitor information or any other type of material which appears on the PastPlaces website. We rely on members and other visitors to report any abuses of the spirit of the website and the terms and conditions of this Agreement.
Module 5 Design reserves the right to remove any advertisement, image or hypertext links or that we consider to be demeaning in nature, abusive or , pornographic.
MATERIAL WITHDRAWL AND TERMINATION OF MEMBERSHIP
Module 5 Design Limited may terminate or suspend membership of our site if any member is found by lawful determination to have participated in any form of fraudulent activity in relation to this site. Module 5 Design Limited will cooperate with any lawful agency with regards to enforceable actions. Module 5 Design Limited will terminate any membership if members infringe any of the terms of this agreement or any intellectual property rights of any member or any other party. Members that have been terminated or suspended will not be allowed to re-register for membership of the PastPlaces website, without the express permission of an Module 5 Design Limited. These actions will be taken without limiting other actions or remedies. We reserve the right to alter, edit or modify any material posted to the PastPlaces website which we feel is in breach of this Agreement or is not, in our opinion, in keeping with the spirit of Pastplaces.
Members are exclusively responsible for any Information that they supply to the PastPlaces website in whatever form, presented via or posted to our site. Module 5 Design Limited will take any action it considers necessary to remove any information that it believe may create liability for us or others.
DISCLAIMER AND RELEASE
In accordance with the extent that the law permits, you agree to release Module 5 Design Limited, its officers, directors, employees and subcontractors and partners from any liability arising from or in connection with any of the services offered by or through the PastPlaces website, including material posted by third parties or members. Further, you agree to indemnify us against all claims, expenses and liabilities arising from any breach of this Agreement by you or through the use of any method or machine used by you to access the PastPlaces website and its services.
PastPlaces has no control of or responsibility for information provided by members or non-members, either passing through via e-mail or other means, or posted to our website. We do not endorse or have any responsibility for any third party sites that have links to or from the PastPlaces website. Use of the PastPlaces website and its services are entirely at your own risk.
Under no circumstances will we be liable to you, any member or to any third party for lost profits, business, revenue, data, information or any related damages indirect or consequent to the use of this site, its hyperlinks or this agreement, by whatever cause.
Module 5 Design Limited and PastPlaces will not be liable for any failure to perform any of our obligations under these terms and conditions if failure to perform is caused by circumstances, which are beyond our reasonable control.
Module 5 Design Limited disclaims all warranties, either expressed or implied, including warranties of quality and fitness for a particular purpose.
INTELLECTUAL PROPERTY
Pastlaces does not claim ownership of the content you submit or upload for display on the Pastplaces webite. However, in order to make use of materials you submit and to assist in promoting Pastplaces.com, members grant Module 5 Design Limited a non-exclusive, royalty free, worldwide license and right to display, copy alter, distribute all materials, information and images, that are covered by intellectual property law, that are submitted or posted to the PastPlaces website and server by whatever means. This also includes the right to use this material for publicity and promotion. This license will terminate at the time you remove such content from the Website. Any copyright that a member has over the original image and other materials remains fully with the member.
Members represent and warrant that: they are the owners the content posted by them on Pastplaces or that they have the right to grant such a license as set forth in this section. Further, that their content does not violate the copyright rights, or other intellectual property rights of any person or legally constituted body. Members agree to pay for all royalties and fees owing to any such person or body by reason of any content that they upload or submit to Pastplaces.
CONTENT
All the material on this website is protected by copyright. No member or any other visitor may mirror, copy, distribute, alter or publicly show any material from the PastPlaces website, unless specifically licensed to do so by Module 5 Design Limited. Only content that specifically has a link box with code that allows image or video embedding may be used on other websites. Images, video and information that is used by Pastplaces under the Creative Commons Licence where indicated may also be used by other websites under the same terms and conditions of the Creative Commons Licence. Hot linking is not allowed without permission. Images and Video content that is hot linked will be replaced with an image that indicates that the content is being used without permission.
We do not have influence over the condition or legal status of materials posted on this site, or comment and statements made about materials by members or other parties, or the legal status of any member. Further, we have no influence or bearing on, or offer no guarantee regarding the ability or intention of members to complete transactions and purchase goods.
MEMBER-TO-MEMBER CONDITIONS
Any disputes, claims for damages of any nature, between members shall be solely and exclusively between members and shall in no way involve any director, shareholder or employee of Module 5 Design Limited.
Payment & delivery terms of any and all materials, good or services that are agreed between members are a matter solely for participating members.
Members will not offer for sale, rent or disposal any goods in any form that are not wholly and legally owned by the member. Members will have permission from the legal owners of goods to offer the goods for sale. Members will not be a party to fraudulent activity, infringe any third party intellectual property rights, trade or industrial secrets, patents or copyrights.
GENERAL TERMS
Member's information must not contain any form of software, which is deleterious to our site of any other user of our site. Members will not covertly gain or intercept information of any form from or about other members or other users of our site. Members may not post information that infers, implies or directly libels, defames or threatens any member or any other user of our site.
Members will not cause us to transgress or break any law, regulation of any form which as applicable to the operation of our site and which is designed to protect the rights and trading or personal interests of our members or visitors.
Members agree not to disrupt or attempt to disrupt the efficient operation of our website by the use of software, hardware or any device known or unknown, or to overload the website with erroneous information or Spam e-mail activities. The judgment of Module 5 Design Limited is final in respect to such activities & members shall be liable to removal from the system without notice.

Members must comply with new terms and conditions that are applied to new or additional PastPlaces Service. We do not guarantee uninterrupted or secure access to our services, and the correct operation of our site may be dictated by outside factors, which are beyond our control. PastPlaces may also be unavailable from time to time due to scheduled or un-scheduled maintenance. We do not accepts responsibility for any down time incurred as a result of any Internet Service Providers whether it be the host used by Module 5 Design Limited or the host used by one of the companies that are hypertext linked to our website.
If any element of this Agreement is found to be invalid or unenforceable, this element shall be removed and the remaining elements shall be enforced. If we fail to take action with respect to a transgression of these terms and conditions by a member or by others, this does not affect our right to take action in connection with any subsequent transgression of any form.
We may make amendments to these terms at any time in the future by posting a notification of change to terms and conditions on this page. The amended terms shall automatically take effect. We reserves the right to modify or update the contents, construction or structure of this website at any time without notice.

Module 5 Design reserve the right to assign this Agreement. Module 5 Design Limited also reserves the right to assign or to subcontract any or all of our rights and or obligations under this Agreement. This Agreement may not be disposed of or assigned by any member without the written consent of an officer of Module 5 Design Limited.
Module 5 Design reserves the right to cancel or modify part or all of this service without notice or obligation, if there is a technical or a legal reason to do so, or if in the commercial opinion of Module 5 Design limited the projected revenue from the PastPlaces service are not commercially viable.
If the above terms & conditions are violated, Module 5 Design Limited may deny access to our website at its sole discretion.
MEMBERS CASHBACK SHOPPING
Pastplaces offers cashback shopping links where indicated to members of the Pastplaces website.
In order to benefit from any Pastplaces Cashbacks from your own shopping you will have to logged on as a member and have cookies enabled. You will also need to have a Paypal account and supply Pastplaces with a valid email address so that we can pay you your cashback via Paypal.
The main way that you can earn a cashback commission from your own shopping is to log on to Pastplaces and look for the links with a red arrow indicator next to them.
There are currently three other ways in which you can earn a cashback commission from Pastplaces:
) If you are a professional or amateur artist you can upload images of your artworks to earn additional revenue from them. Simply set up an artists biography page and upload examples of your works of art. Vvisitors who click on the text based shopping links on the right hand side of this pages and subsequently make a purchase are tracked by your Pastplaces membership number. Validated sales are then awarded commissions.
2) You can earn commission on valid purchases made by visitors through the pastplaces members shopping links on your Pastplaces Public Membership Page
3) Download and use any image that Pastplaces indicates can be used on your own website, together with a text link back to Pastplaces and you can earn additional income
Pastplaces currently pays up to 50% of the available valid commission to members on the links on cashback pages or on pages where cashback links are indicated.
All decisions relating to the validity of a commission lie with each individual retailer who is listed on the cashback links pages. if the retailer does not award Pastplaces with its commission then we cannot reward you with a commission. By using the cashback shopping links you agree to abide by and accept this rule.
When pastplaces commissions are awarded they will show up on your main membership page as pending.
When the retailer pays Pastplaces for each individual transaction Pastplaces will set your transaction to confirmed. Once you confirmed total reaches £50 sterling or above Pastplaces will pay you your commission via Paypal.
All commissions will be shown in £ sterling. Purchases made in US dollars will be converted to pounds sterling at the exchange rate that is current at the time that Pastplaces is notified that a commission is pending.
Pastplaces cashback will only be awarded if the transaction for goods or services is completed. If you return the goods or your application for a service is rejected by the retailer then the commission will be removed from your pending total.
As soon as our commission partners report the sale to Pastplaces we will update your cashback pending balance.
If the retailer indicates that the transaction is fraudulent in any way then any outstanding commission is forfeit and membership of Pastplaces will be removed
